NFL retirement plan violated ERISA, Texas judge rules

By Katie Buehler (May 26, 2022, 6:54 p.m. EDT) — A Texas federal judge on Thursday blasted the NFL Players’ Retirement Plan for a history of selectively reviewing disability benefit claims from former players and of abuse of discretion, concluding that the plan violated federal benefits law by denying a retired Super Bowl winner from placing a running back in a higher benefits class.

U.S. District Judge Karen Gren Scholer issued a scathing oral ruling finding that NFL players Bert Bell/Pete Rozelle’s retirement plan violated employee retirement income security law by denying Michael Cloud a full review fairness of his 2016 reclassification request.
